Dr. Henry Morgentaler

Series consists of files relating to Dr. Henry Morgentaler and the pro-choice movement. Series contains notes, newspaper clippings, pamphlets, leaflets, newsletters, court transcripts, book excerpts, and correspondence.
Dr. Henry Morgentaler was a gynecologist and abortion activist from Montreal. Morgentaler was caught performing illegal abortions in 1970. He went to trial in 1973 and was acquitted. However, in 1974 his acquittal was overturned and he was sent to jail. He spent time in jail, appealed and was acquitted for a second time. Morgentaler was charged again in 1983 for "procuring illegal miscarriages." Although he was acquitted by a jury, the verdict was reversed and was sent to the Supreme Court of Canada where he was acquitted once again. This last ruling in the Morgentaler case essentially ended all statutory restrictions on abortion in Canada. In 1993, he won another case before the Supreme Court, this time challenging provincial abortion regulations. Throughout all the legal battles, Morgentaler continued to practice abortions at his Toronto clinic, which was subsequently bombed by anti-abortionist groups May 19, 1992. He also opened up a Winnipeg Clinic and an Edmonton Clinic, which was also subjected to arson July 1991. Morgentaler's case is an extremely influential legal battle in the pro-choice movement.
